1. Acceptance of Terms

Welcome to Acad Up. By downloading, installing, or using the Acad Up application ("App", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the App.

If you do not agree to these Terms, you must not use the App. By continuing to use Acad Up, you confirm that you are at least 13 years of age, or that you have obtained verifiable parental or guardian consent if you are under 13.

These Terms apply to all users of the App, including users who access content, practice tests, or the AI assistant feature.

2. Description of Service

Acad Up is an exam preparation platform that provides:

Multiple Choice Questions (MCQs) for various competitive and academic examinations
Previous Year Questions (PYQs) for exam practice
Mock Tests to simulate real exam conditions
An AI-powered assistant to help users with exam-related queries and guidance
Performance tracking and practice history analytics

We reserve the right to modify, suspend, or discontinue any feature or aspect of the App at any time, with or without notice.

3. User Accounts

3.1 Account Registration

To access the App, you must create an account by providing your name and phone number. You agree to provide accurate and complete information and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised access to your account.

3.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, gain unfair advantages, or abuse any feature of the App is prohibited.

3.4 Account Deletion

You may delete your account at any time through Settings within the App. Upon deletion, your personal data will be permanently removed within 30 days in accordance with our Privacy Policy.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:

Use the App in any way that violates applicable local, national, or international laws or regulations
Copy, reproduce, distribute, or create derivative works from any content within the App without our prior written permission
Attempt to gain unauthorised access to any part of the App, its servers, or any system connected to the App
Use any automated tools, bots, scrapers, or scripts to access, extract, or interact with the App's content
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Upload, transmit, or distribute any harmful, offensive, or disruptive content through the AI chat feature
Attempt to reverse-engineer, decompile, or disassemble any part of the App
Use the App to engage in any commercial activity without our prior written consent

We reserve the right to suspend or terminate accounts that violate these acceptable use guidelines.

5. AI Assistant Feature

The App includes an AI-powered assistant to help with exam preparation. By using this feature, you acknowledge and agree that:

The AI assistant is provided for educational and informational purposes only
Responses generated by the AI may not always be accurate, complete, or up to date — always verify important information from authoritative sources
You must not use the AI assistant to generate harmful, abusive, or inappropriate content
Your conversations with the AI assistant are stored and may be used to improve the service, as described in our Privacy Policy
We are not responsible for any decisions made based on AI-generated responses

6. Intellectual Property

6.1 Our Content

All content within the App, including but not limited to questions, answer explanations, mock tests, graphics, logos, and software, is owned by or licensed to Acad Up and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any App content without our express written permission. The App may also include Past Year Questions (PYQs) sourced from publicly available government examination papers. Such questions are the property of their respective examining bodies and are reproduced here solely for educational and reference purposes. Acad Up does not claim ownership over such third-party content.

6.2 Your Content

Any content you submit through the App, including AI chat messages, remains your property. However, by submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, process, and store such content for the purpose of providing and improving the App.

6.3 Feedback

If you provide us with any feedback or suggestions regarding the App, we may use such feedback without any obligation to compensate you.

7. Disclaimers

The App and its content are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Guarantees that the App will be uninterrupted, error-free, or free of viruses or other harmful components
Guarantees regarding the accuracy, completeness, or reliability of any content, including questions, answers, or AI-generated responses

Acad Up is a preparation tool and does not guarantee success in any examination. Results depend on individual effort, preparation, and various other factors beyond our control.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Acad Up and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, including but not limited to:

Loss of data or content
Loss of revenue or profits
Errors or inaccuracies in exam content or AI responses
Unauthorised access to or alteration of your data

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, or INR 500, whichever is greater.

9. Subscriptions and Payments

Certain features of the App may require a paid subscription. If you purchase a subscription:

All payments are processed securely through the Google Play Store
Subscription fees are charged at the start of each billing cycle
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
You may cancel your subscription at any time through your Google Play Store account settings
Refunds are subject to Google Play's refund policy

We reserve the right to change subscription pricing with reasonable advance notice. Continued use of the App after a price change constitutes acceptance of the new pricing.

10. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without prior notice, for reasons including but not limited to:

Violation of these Terms
Conduct that we believe is harmful to other users, third parties, or the App
Extended periods of inactivity

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply, including intellectual property rights, disclaimers, and limitations of liability.

You may terminate your agreement with us at any time by deleting your account and uninstalling the App.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

We encourage you to contact us first to resolve any disputes informally before pursuing formal legal proceedings.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time at our sole discretion. Changes take effect as soon as they are posted. Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
